1. Acceptance of Terms

By downloading, installing, or using TalkVerse ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and TalkVerse ("we," "our," or "us").

2. Eligibility

To use TalkVerse, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the App under applicable laws

By creating an account, you represent and warrant that you meet all eligibility requirements. We verify age during the onboarding process.

3. Account Registration

You must create an account using Google Sign-In to access the App. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure
• Notify us immediately of any unauthorized use of your account
• Not share your account with others

4. Nature of the Service

TalkVerse provides AI-powered chat and roleplay experiences. You acknowledge that:

• All AI characters are fictional and generated by machine learning models
• AI characters do not represent real people, living or deceased
• Conversations are simulated and for entertainment purposes only
• AI responses may not always be accurate, appropriate, or factual
• The App is not a substitute for professional advice (medical, legal, psychological, etc.)
• AI characters may send proactive messages via push notifications

5. Acceptable Use

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm any person (including AI interactions intended to train harmful behavior)
• Generate, share, or solicit content involving minors in any inappropriate context
• Attempt to extract, reverse-engineer, or manipulate AI model behavior for malicious purposes
• Use the App for any commercial purpose without our written consent
• Impersonate any person or entity
• Distribute malware, spam, or any harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts, bots, or scraping tools on the App

6. User Content

"User Content" includes messages you send to AI characters, profile information, and any other content you provide through the App. By submitting User Content, you:

• Retain ownership of your User Content
• Grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content for the purpose of providing and improving our services
• Represent that your content does not violate any third-party rights
• Acknowledge that we may use anonymized, aggregated data to improve AI models

7. AI-Generated Content

Content generated by AI characters is provided "as is" for entertainment purposes. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated responses. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• AI responses do not constitute professional advice of any kind
• You should not rely on AI-generated content for important decisions
• We are not liable for any actions you take based on AI-generated content

8. Intellectual Property

The App, including its design, features, AI models, character designs, code, and content (excluding User Content), is owned by TalkVerse and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the App
• Reverse engineer or decompile the App or its AI systems
• Use our trademarks, logos, or branding without written permission
• Create derivative works based on the App

9. Termination

We may suspend or terminate your account at any time if you:

• Violate these Terms
• Engage in abusive or harmful behavior
• Provide false information during registration
• Use the App in a way that could harm us or other users

You may delete your account at any time. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free service
• Accuracy or reliability of AI-generated content
• Security of data transmission

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of data or profits
• Emotional distress caused by AI interactions
• Unauthorized access to your account
• Actions taken based on AI-generated content
• Service interruptions or downtime

12. Indemnification

You agree to indemnify, defend, and hold harmless TalkVerse, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
